Welcome to Automotive Database. By accessing or using our service, you agree to be bound by these Terms of Service.

1. Service Description

Automotive Database provides access to a curated database of automotive industry information, including:

• OEM news articles and technical documentation

• Conference and trade show listings

• Patent information (Pro+ plan)

Our service is designed for automotive professionals, researchers, and companies seeking centralized industry intelligence.

2. Account Registration

2.1 Eligibility

You must be at least 18 years old to use our service. By creating an account, you represent that you meet this requirement.

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password

• All activities that occur under your account

• Notifying us immediately of any unauthorized use

2.3 Account Information

You agree to provide accurate, current, and complete information during registration and keep it updated.

3. Subscription Plans and Pricing

3.1 Available Plans

Pro Plan:

• Early Adopters (first 50 users): €29/month or €278/year - locked for life

• Standard pricing: €49/month or €470/year

Pro+ Plan (launching Q1 2025):

• Early Adopters: €39/month (locked for life) + 3 months free

• Pre-Pro+ users: €59/month

• Standard pricing: €79/month

3.2 Free Trial

New users receive a 7-day free trial with access to all features. Your subscription will automatically begin after the trial period ends unless you cancel before the trial expires.

3.3 Payment

• Payment is processed by Lemon Squeezy

• Accepted payment methods: Credit card, debit card, and other methods supported by Lemon Squeezy

• All prices are in Euros (€) and include applicable VAT

3.4 Billing

• Monthly subscriptions are billed on the same day each month

• Annual subscriptions are billed once per year on your subscription anniversary

• You will receive an invoice via email after each payment

3.5 Price Changes

• We reserve the right to modify our pricing with 30 days' notice

• Early adopter pricing is locked for life and will not change

• Price increases do not apply retroactively to existing subscriptions at standard pricing

4. Cancellation and Refunds

4.1 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period.

4.2 Refund Policy

• No refunds are provided for partial months or unused time

• Refunds may be granted at our sole discretion in exceptional circumstances

• EU consumers have a 14-day right of withdrawal, which is waived if you access the service during the trial period

4.3 Non-Payment

If payment fails, we will attempt to process payment again. After multiple failed attempts, your account may be suspended or terminated.

5. Acceptable Use

5.1 Permitted Use

You may use Automotive Database for:

• Professional research and business intelligence

• Internal company use

• Educational and academic purposes

5.2 Prohibited Activities

You may NOT:

• Share your account credentials with others

• Scrape, crawl, or mass-download content from the database

• Redistribute, resell, or sublicense access to the service

• Use the service for illegal purposes or to violate any laws

• Attempt to reverse engineer or hack the platform

• Use automated tools to extract large amounts of data

• Impersonate others or provide false information

5.3 Consequences

Violation of these terms may result in immediate account suspension or termination without refund.

6. Intellectual Property

6.1 Our Content

All content on Automotive Database, including articles, data, software, designs, and trademarks, is owned by Automotive Database or its content providers and protected by copyright and intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our service for your personal or internal business purposes. This license does not include any right to:

• Copy, modify, or distribute our content

• Create derivative works

• Use our content for commercial purposes outside your organization

6.3 User Content

If you submit feedback, suggestions, or other content to us, you grant us a worldwide, perpetual, royalty-free license to use that content to improve our service.

7. Service Availability

7.1 Uptime

While we strive for high availability, we do not guarantee uninterrupted access to our service. We may experience:

• Scheduled maintenance

• Emergency maintenance

• Technical issues beyond our control

7.2 Updates and Changes

We reserve the right to:

• Modify, update, or discontinue features

• Change the service structure

• Update these Terms of Service

We will provide reasonable notice of significant changes.

8. Data and Privacy

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy.

9. Limitation of Liability

Automotive Database is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Non-infringement

• Uninterrupted or error-free operation

9.2 Limitation of Damages

To the maximum extent permitted by law, Automotive Database shall not be liable for:

• Any indirect, incidental, special, or consequential damages

• Loss of profits, data, or business opportunities

• Damages exceeding the amount you paid us in the 12 months preceding the claim

9.3 Important Note

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages. In such cases, our liability is limited to the extent permitted by law.

9.4 User Responsibility

You are responsible for:

• Verifying the accuracy of information for critical decisions

• Backing up any data you consider important

• Complying with all applicable laws in your use of the service

10. Indemnification

You agree to indemnify and hold harmless Automotive Database, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service

• Your violation of these Terms

• Your violation of any third-party rights

• Any content you submit or transmit through the service

11. Termination

11.1 By You

You may terminate your account at any time by canceling your subscription through your account settings.

11.2 By Us

We may suspend or terminate your account if:

• You violate these Terms of Service

• You engage in fraudulent activity

• Payment fails repeatedly

• We are required to do so by law

11.3 Effect of Termination

Upon termination:

• Your access to the service will end

• We will delete your data in accordance with our Privacy Policy

• Billing data will be retained for 10 years (legal requirement)

• No refunds will be provided for the unused portion of your subscription

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or your use of the service shall be resolved exclusively in the courts of France.

12.3 Informal Resolution

Before filing a lawsuit, you agree to try to resolve disputes informally by contacting us at legal@automotive-database.com. We will make good faith efforts to resolve any issues.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Automotive Database.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

13.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.

13.5 Force Majeure

We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control.

13.6 Language

These Terms are provided in English. In case of conflict between translations, the English version prevails.
